Terms & Conditions for Creators

1. Acceptance and Scope
This document ("Creator Terms" or "Terms") governs the relationship between Next Level UGC ("Next Level", "we") and content creator users ("Creator", "user") who participate in campaigns, projects, or services managed by Next Level, whether through the nextlevelugc.com platform or other operational means (forms, email, third-party tools, etc.).
These Terms are an integral part of the General Terms and Conditions of Use of Next Level, as well as any specific agreement that Next Level enters into with Brands or with the Creator themselves.
By registering, applying to campaigns, accepting a brief, receiving products, or executing content, the Creator declares:
If the Creator does not agree, they should not register or participate in campaigns.

- Also accepting the Privacy Policy and other terms published by Next Level
2. Definitions
- Platform: Website, forms, systems, and digital tools under the domain nextlevelugc.com or integrations authorized by Next Level.
- Creator / User: Individual who registers or collaborates with Next Level to participate in campaigns, create content, and/or publish content on their own accounts.
- Brand / Client: Legal entity, company, or organization that engages Next Level to develop campaigns, UGC content production, Full Next Level, e-commerce optimization, or other services.
- Campaign: Commercial, promotional, content, or research action created by a Brand and managed by Next Level (including UGC Performance, Full Next Level, marketplace campaigns, etc.).
- Content: All audiovisual, graphic, textual, or other digital material generated by the Creator (videos, photos, scripts, captions, reviews, testimonials, etc.).
- Deliverables: Content selected by Next Level and/or the Brand as final deliverables of a campaign or project.
- Creator Posting: Publication of Content or Deliverables on the Creator's own profiles on social media or digital platforms (TikTok, Instagram, YouTube, etc.).
- Fees / Incentives: Payments, reimbursements, products, Gift Cards, or other benefits agreed upon for a campaign.
3. Registration and Eligibility
3.1. Only individuals may register as Creators who are:

All information is considered a sworn declaration. The Creator shall be solely responsible for its accuracy and shall indemnify Next Level against any claim arising from false, incomplete, or outdated information.
3.3. Next Level may, at any time, request identity and account verification (screenshots, links, verification videos, etc.). Unjustified refusal may result in:
3.4. Next Level reserves the right to accept, reject, or cancel any registration or campaign access without obligation to justify the decision.
- Over 18 years of age
- With full legal capacity to contract
- Who provide truthful and up-to-date information
- Personal data
- Tax information (if applicable)
- Social media and platform links
- Information about country, language, accent, and availability
- Account suspension
- Loss of access to campaigns
- Cancellation of pending incentives
4. Relationship Between the Parties
4.1. The Creator always acts as an independent contractor, never as an employee, partner, representative, or agent of Next Level or the Brands.
4.2. The Creator is responsible for:
4.3. Nothing in these Terms shall be construed as creating an employment relationship, agency, franchise, joint venture, or partnership between the Creator and Next Level or the Brands.
- Their taxes, contributions, and social charges
- Compliance with applicable labor and social security regulations
- The permits and licenses required for their activity
5. Campaign Participation
Brands that promote their products through Next Level may launch campaigns to obtain user content, reviews, and ratings. Each campaign will establish requirements such as age, location, product type, specific characteristics or interests, content volume, formats, scripts, claims, and restrictions.
Creators may apply to multiple campaigns simultaneously. However, selection will be subject to each Brand's and Next Level's criteria, and not being selected will not entitle the Creator to claims or compensation.
In addition to the guidelines indicated in each campaign, the Creator accepts and agrees that:
Next Level may exclude the Creator from future campaigns, suspend the account, manage internal sanctions, and/or withhold incentives if:
- Content must be delivered through the channels and formats specified by Next Level and the Brand, meeting delivery and publication deadlines
- Will read and respect the complete brief, creative and regulatory guidelines, reasonably responding to aligned adjustment requests
- In campaigns with monetary benefits or reimbursements, the Creator must send clear proof of publication (active link, screenshots, and requested metrics)
- Any modification requested by the Brand or Next Level before the delivery date must be addressed within a reasonable time
- Next Level may collect, store, and display public information from their social media profiles, including username, links, follower count, posts, and any other publicly visible data, for the purpose of facilitating the campaign selection and management process
- Does not deliver content on time and in the correct format
- Breaches the brief or regulatory guidelines
- Acts in bad faith (fraud, bots, purchased followers, etc.)
- Damages the reputation of the Brand or Next Level
6. Binding Nature of Application
By clicking "Apply", "View and Apply", accepting a brief, or confirming participation by any means, the Creator:
Non-compliance may result in penalties, future exclusions, or legal claims.
- Assumes a binding contractual obligation to produce the Content
- Commits to publishing when the campaign requires it
- Accepts to follow guidelines, deadlines, and formats
- Accepts to collaborate with Next Level to complete deliveries and make reasonable adjustments
7. Licenses and Rights Over Content
The Creator grants Next Level and/or the Brand (with Next Level's approval) a non-exclusive, worldwide, transferable, sublicensable, irrevocable, royalty-free, and perpetual license to:
The Creator expressly authorizes Next Level to sublicense the content to Brands for the required scope, term, and channels.
This may include, but is not limited to:
Additionally, grants and authorizes Next Level and Brands, for the term of the above licenses, the use of: their image, voice, name, alias, user handle, and any personality element appearing in the Content, within the framework of campaigns and derived materials, waiving image rights claims within the agreed time, territory, and usage limits.
The Creator declares and warrants that:
The Creator agrees to indemnify Next Level and Brands against any claim related to intellectual property, image rights, or misuse of the Content.
7.5. Use of content in the Creator's portfolio.
The Creator may use Content produced within Next Level campaigns for their personal or professional portfolio, including:
This authorization is subject to:
- Reproduce, adapt, edit, cut, subtitle, dub, translate, and create derivative works of the Content
- Distribute and publicly communicate it through any digital or audiovisual medium
- Include it in Next Level marketing materials, promotional materials, presentations, case studies, credentials, and portfolios
- Use it for internal analysis, benchmarking, and creative model training (excluding sensitive personal data)
- Brand use on social media (organic and paid)
- Use on marketplaces (Amazon PDP/A+, TikTok Shop, Shopify, etc.)
- Use on websites, emails, and other digital assets
- The content is original and does not infringe third-party rights
- Has all necessary rights, licenses, and permissions
- Does not use music, images, trademarks, or third-party content without valid authorization
- In case of appearance of third parties (including minors), has the corresponding legal authorizations and consents
- Reels or compilations of previous work on their social media profiles
- Portfolio on professional platforms (LinkedIn, Behance, personal website, etc.)
- Presentations to potential clients or agencies
- Not use the content to promote brands competing with the original Brand
- Maintain confidentiality about strategies, internal briefings, and commercial results
- Not make claims about the Brand that were not approved in the original campaign
- Clearly indicate that it is work done in collaboration with Next Level when appropriate
8. Publication Conditions and Minimum Posting Period
8.1. When the campaign includes Creator Posting, the Creator commits to:
8.2. During that period, the Creator may not, without Next Level's prior approval:
8.3. If for any reason the Creator deletes, hides, or materially alters the Content before the minimum period:
8.4. It will not be considered a breach when the deletion is exclusively due to:
In such cases, the Creator agrees to cooperate in good faith to agree on reasonable solutions (e.g., republishing from a new account).
- Publish the Content on the indicated profiles and platforms
- Respect required formats, hashtags, mentions, and texts
- Keep publications visible for at least 90 consecutive days (or the longer period indicated in the brief/campaign)
- Delete the content
- Archive it
- Set it as private or restricted
- Edit it in a way that alters the message, approved claims, or the brand
- Upon Next Level's simple request, must replace the publication or create and publish equivalent replacement content, at no additional cost to Next Level or the Brand
- Next Level may withhold all or part of any pending incentive derived from that piece, and even offset amounts to be returned or credited to the Client for said breach
- Closure or suspension of the Creator's account by the platform through no fault of the Creator
- Duly documented force majeure causes
9. Conduct, Prohibited Content, and Confidentiality
9.1. The Creator commits to not creating or publishing content that:

All non-public material received by the Creator (briefings, strategies, internal documents, product sheets, performance information, etc.) is confidential and:
- Promotes hatred, violence, discrimination, harassment, or illegal activities
- Includes explicit nudity, pornography, or sexually explicit content
- Includes weapons, illegal drugs, or controlled substances
- Seriously damages the reputation of the Brand or Next Level
- Contradicts regulatory instructions, disclaimers, or claims authorized by the Brand
- Defame Brands, Next Level, or other Creators
- Make negative public comments about ongoing campaigns
- Reveal briefs, strategies, internal documents, commercial, or non-public information
- May only be used to execute the corresponding campaign
- May not be shared with third parties
- Must be deleted upon Next Level's request or at the end of the campaign
10. No Bypass / No Direct Brand Solicitation
During the term of the relationship with Next Level and for a period of six (6) months from the last campaign in which the Creator participated:
Next Level may, in case of violation:
- The Creator commits to not contacting, negotiating, or directly contracting with a Brand or agency accessed through Next Level, for the same or similar services, without Next Level's prior written authorization
- Cancel the Creator's account
- Permanently exclude them from future campaigns
- Claim a reasonable placement fee on contracts the Creator has entered into outside Next Level, where permitted by law
11. Rewards, Payments, and Taxes
11.1. Each campaign will clearly define:

Next Level is not responsible for advising or managing the Creator's tax obligations.
- Type of incentives (money, products, reimbursement, Gift Cards, hybrid)
- Eligibility requirements
- Payment terms and methods
- Having fully complied with the campaign (production, publication, and posting period, as applicable)
- Sending proof of publication (links, screenshots, requested metrics)
- Issuing an invoice or tax receipt when required in their country
- Using alternative payment mechanisms (e.g., Gift Cards, payment platforms, etc.)
- Conditioning participation in certain campaigns to the submission of minimum tax documentation
- Their taxes, charges, and tax obligations
- Declaring income received from Next Level in accordance with applicable legislation
12. Cancellations, Absences, and Penalties
12.1. Next Level and/or the Brand may cancel a campaign or a Creator's participation at any time if detected:
12.2. In case of cancellation for reasons beyond the Creator's control:
12.3. In case of cancellation attributable to the Creator:
- Brief non-compliance
- Fraud (fake followers, manipulated metrics, etc.)
- Inappropriate conduct or conduct contrary to these Terms
- Substantial changes in the Client's product, budget, or strategy
- Next Level will endeavor, in good faith, to recognize work effectively performed and validated up to that point (e.g., proportional payments when applicable)
- Next Level may choose not to pay the incentives associated with the campaign
- May, if applicable, claim the return of unused products
- May suspend or cancel the account on the Platform
13. Platform Intellectual Property and Limitation of Liability
13.1. Platform and tools. All code, design, methodologies, creator selection processes, script frameworks, dashboards, and know-how used by Next Level are the exclusive property of Next Level or its licensors.
13.2. Limitation of Liability
To the maximum extent permitted by applicable law:
13.3. Next Level does not guarantee:
- Next Level shall not be liable to the Creator for indirect damages, lost profits, loss of opportunity, data loss, or reputational damage
- Next Level's total liability to the Creator, if any, shall be limited to the total amount effectively paid to the Creator for the specific campaign from which the claim arises
- Creator selection in specific campaigns
- Minimum work volumes
- Commercial results for the Creator or for Brands
- Stability or behavior of third-party platforms (TikTok, Meta, YouTube, Amazon, etc.), which are beyond its control
14. Modifications, Applicable Law, and Jurisdiction
14.1. Next Level may modify these Terms at any time. Updated versions will be published on the Platform or communicated through reasonable channels. Continued use of the Platform or participation in campaigns implies acceptance of the Terms in effect at that time.
14.2. Unless otherwise established in a specific contract signed with the Creator, these Terms are governed by the laws of the Republic of Argentina, and any dispute shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires.
In case an MSA/SOW between Next Level and a Brand establishes a different law or jurisdiction for that relationship, said stipulation does not alter the direct legal relationship between Next Level and the Creator, which will continue to be governed by these Terms, unless otherwise agreed in writing.
